Waller County, Texas publishes two useful criminal-record routes. The District Clerk has a public court-access portal; the County Clerk describes a misdemeanor collection extending from the late 1800s to the present. Read the court and clerk on the case before requesting copies. A result from one office should not be assumed to include every proceeding held by the other.
If you already have a citation, notice or case reference, begin with that identifier and approximate year. When the outcome is the question, specify the judgment or disposition you need. An event in an index can point to the right paper without explaining whether a charge led to conviction, dismissal or some other result.
Open Public Access to Court Records from the District Clerk’s page. The office expressly says document images are not available on the public site. For a listed event, call 979-826-7735 and request its copy. Note the case number, event date and event description first; a missing download icon is an expected limitation of the portal, not evidence that the document does not exist.
Tell the office whether you need a plain copy or certification and how you want it delivered. Ask for the fee for that particular record and any certification before paying. The District Clerk’s published instruction establishes the telephone copy route but does not make the County Clerk’s misdemeanor copy prices applicable to a District Clerk request.
District Clerk is at the Waller County Justice Center, 400 Sheriff R. Glenn Smith Drive, Building A, Hempstead, TX 77445, with weekday hours of 8 a.m.–4:30 p.m. Its notice effective August 1, 2024 ends personal-check acceptance. Listed alternatives are money order, cashier’s check, credit card, or cash only when the amount is less than $100.
Confirm the amount and applicable delivery option with 979-826-7735 before traveling or mailing funds. In particular, do not use a payment statement from another county department as permission to send a personal check to the District Clerk. Include the case reference with follow-up so staff can connect the inquiry to the requested event.
The County Clerk Criminal Court page permits criminal-record searches during regular office hours and charges $5 per name when staff conducts the search. For an older misdemeanor, give the recorded name and approximate period; the late-1800s collection may be relevant even if an online case result is absent. State whether you need a search result, the case reference or a copy of a specific document.
| County Clerk service | Published fee |
|---|---|
| Staff criminal-record search | $5 per name |
| Photocopy | $1 per page |
| Certified copy | $1 per page plus $5 to certify |
This office lists cash, debit/credit card, money order or cashier’s check. Its criminal-record page gives the County Clerk address as 836 Austin Street, Suite 1200, Hempstead, TX 77445. Search charges and document-copy charges buy different services, so clarify the requested output and number of certified documents when asking for a total.
The County Clerk states that juvenile records are closed to the public. The broad historical date range does not remove that restriction. For a missing adult case, ask the appropriate clerk about the year, court and any earlier case number; do not infer a clean history solely from an empty portal result. Keep possible same-name cases separate until the identifiers support a match.
If the recipient wants a Texas criminal-history repository check instead of a Waller court document, Texas DPS Crime Records provides separate public-history and personal-review instructions. It also links criminal-history error resolution. Use that process for an inaccurate repository entry and the filing clerk for the underlying court order. A local copy request does not itself correct the statewide record or establish statewide coverage.
